Praise is to Allah. We seek refuge in Him. He is not misguided. He who is guided by Allah no one shall mislead him. And no one shall guide a misleading person. I testify that there is no god but Allah, who has no partner and that Muhammad is His servant and His Messenger.
My honorable customer,
If the heirs are limited to a wife and a son only, the wife has the eighth 1/8. Allaah says "If you have a child, then you are the eighth of what you left after a commandment or a debt."
Also prophet Muhammed PBUH said: "Give the shares to those who are entitled to them, and what remains over goes to the nearest male heir"
So, do not follow the fatwa in writing, so it is necessary to go to the Shari'a court to make sure that the judge is not in debt. Or commandments, or heirs unknown, and then divided by the legitimate\sharia way.
I ask Allah to guide you to what He loves and pleases, and to go beyond the evils of your deeds and to enter us and you in His mercy.
